1. Acceptance and scope
By accessing this website, creating an account, submitting a booking or registration, signing an agreement, or placing an order, you agree to these Terms of Service. If you do not agree, do not use the website or purchase the services.
These terms apply to the website and to photography, event coverage, portrait sessions, team services, registrations, galleries, prints, products, digital downloads, donations, and related services provided by OpticsMedia Productions. A signed proposal, event agreement, invoice, or other project-specific agreement may add to or replace a particular part of these terms for that project.
2. Eligibility and client authority
You must be legally able to enter a binding agreement. If you act for a team, school, organization, business, athlete, participant, or minor, you confirm that you have authority to provide instructions, approve the services, and grant the permissions you give. A parent or legal guardian must complete any consent that is required for a minor.
3. Requests, bookings, and availability
A website request does not reserve a date unless OpticsMedia Productions confirms the booking and any required agreement and retainer are completed. Availability, scope, locations, timing, deliverables, and pricing are not final until confirmed in writing. OpticsMedia Productions may decline a request when the requested work, location, schedule, safety conditions, or permissions cannot be accommodated.
4. Pricing, retainers, taxes, and payment
Prices are shown in U.S. dollars unless stated otherwise. Quotes may expire on the date shown and may change when the scope, schedule, travel, venue, products, participants, or delivery requirements change. Applicable taxes, shipping, venue fees, travel, permits, rush charges, and third-party costs may be added.
Any retainer and payment schedule will be identified during booking or on the invoice. Unless a written agreement states otherwise, balances must be paid by the stated due date. Late, failed, disputed, or reversed payments may pause services, delivery, gallery access, licensing, or future bookings. Donations are voluntary payments and do not purchase a service unless expressly stated.
5. Cancellations, rescheduling, and weather
Cancellation and rescheduling rights, deadlines, fees, and retainer treatment may be set in the applicable proposal or service agreement. When no project-specific term applies, contact OpticsMedia Productions as soon as possible. A new date is subject to availability and may require updated pricing.
OpticsMedia Productions may pause, relocate, reschedule, or end coverage when weather, illness, venue restrictions, unsafe conduct, equipment risk, transportation problems, emergencies, or circumstances outside reasonable control make performance unsafe or impracticable. The parties will work in good faith toward a reasonable alternative where possible.
6. Events, registrations, and participation
Event organizers and registrants are responsible for accurate names, contact details, rosters, schedules, participant information, and permissions. Registration does not guarantee playing time, attendance, a specific photograph, or inclusion in every gallery. Organizers remain responsible for participant supervision, venue rules, safety, and required releases. Event-specific eligibility, payment, transfer, refund, and media terms displayed during registration also apply.
7. Access, cooperation, and safe conduct
The client must obtain any venue access, credentials, permissions, and cooperation reasonably needed to perform the services. OpticsMedia Productions is not responsible for missed images caused by late arrival, schedule changes, blocked access, participant absence, venue rules, guest interference, poor lighting, or inaccurate information. Abusive, discriminatory, threatening, unlawful, or unsafe conduct may result in removal, suspension, or cancellation of service.
8. Creative discretion, editing, and delivery
The client acknowledges OpticsMedia Productions' photographic style and grants reasonable creative discretion over coverage, image selection, composition, lighting, editing, color, cropping, and delivery. Not every image captured will be selected or delivered. Raw, unedited, rejected, duplicate, test, or technically unsuitable files are not included unless expressly agreed in writing.
Delivery dates are estimates unless expressly guaranteed in a written agreement. Online galleries and files may expire after the communicated access period. Clients should download and back up delivered files promptly. Long-term archival is not guaranteed after final delivery or gallery expiration.
9. Copyright, licenses, and portfolio use
Except for materials owned by the client or another rights holder, OpticsMedia Productions retains copyright and ownership of the photographs and other original creative work it produces. Purchase or delivery does not transfer copyright unless a written assignment expressly says so.
The client receives only the usage license stated with the product, gallery, invoice, or agreement. Unless commercial rights are expressly included, delivered images are licensed for the purchaser's personal, noncommercial use. Images may not be resold, sublicensed, entered into stock libraries, used to train artificial-intelligence systems, materially altered, have watermarks or credits removed, or be used for advertising or merchandise without written permission.
Any right for OpticsMedia Productions to use identifiable client images for its portfolio, website, social media, competitions, advertising, or studio samples is governed by the applicable release, registration consent, or project agreement. OpticsMedia Productions will honor any narrower written privacy or usage commitment it has accepted.
10. Client-provided content
If you provide logos, music, copy, photographs, names, trademarks, rosters, or other materials, you confirm that you have permission to provide and use them for the requested services. You remain responsible for their accuracy and legality. Do not upload confidential, infringing, harmful, or unlawful material.
11. Digital downloads and galleries
A purchased digital download is made available to the purchaser through the client account, download page, email instructions, or another secure method after the order is successfully processed. Access links and account credentials are personal and may not be publicly posted, shared for mass distribution, or used to bypass product limits.
Because digital products can be delivered immediately, completed digital-download purchases are generally final except where the file is defective, the wrong product was delivered, or applicable law requires otherwise. Contact OpticsMedia Productions promptly if a link or file does not work so the issue can be reviewed.
12. Prints, products, shipping, and returns
Print and product appearance may vary slightly from a screen because of cropping, materials, calibration, and production processes. Fulfillment and shipping estimates are not guarantees. The purchaser is responsible for an accurate shipping address and for reviewing crop and product selections before ordering.
Custom and made-to-order products are generally final once production begins. Report damaged, defective, or incorrect items promptly with photographs of the product and packaging. Any replacement, refund, or return will be determined under the displayed store policy, fulfillment partner requirements, and applicable law.
13. Website, accounts, and acceptable use
You are responsible for activity under your account and for keeping passwords, access codes, gallery links, and download links secure. Do not probe, scrape, copy, overload, reverse engineer, disrupt, or gain unauthorized access to the website, its accounts, galleries, payment systems, or data. Do not impersonate another person, submit false information, automate purchases without permission, or use the website to violate law or another person's rights. Access may be limited or terminated to protect clients, the business, or the website.
14. Third-party services
The website may rely on third parties for payments, hosting, email, analytics, printing, fulfillment, delivery, maps, or other functions. Their separate terms and privacy practices may apply when you use their services. OpticsMedia Productions is not responsible for an interruption, delay, security event, policy, or act that is solely within a third party's control, but will take reasonable steps to assist with service issues connected to an order.
15. Service disclaimers and limitation of liability
Services and website features are provided with reasonable professional care, but uninterrupted website access, error-free files, a particular artistic result, or capture of every person or moment cannot be guaranteed. To the fullest extent permitted by law, OpticsMedia Productions is not liable for indirect, incidental, special, punitive, or consequential losses, including lost profits, opportunities, data, or enjoyment.
To the fullest extent permitted by law, total liability arising from a claim will not exceed the amount the claimant paid OpticsMedia Productions for the specific service or order giving rise to that claim. Nothing in these terms excludes a warranty, remedy, or liability that cannot legally be excluded or limited.
16. Responsibility for third-party claims
To the extent permitted by law, you agree to be responsible for third-party claims, losses, or reasonable costs caused by your unlawful use of the website or delivered work, your breach of these terms, or materials and instructions you supplied without the necessary rights or authority. This section does not make you responsible for OpticsMedia Productions' own negligence, willful misconduct, or violation of law.
17. Events beyond reasonable control
Neither party is responsible for delay or nonperformance caused by events beyond reasonable control, such as severe weather, natural disaster, epidemic, government action, utility or network failure, venue closure, labor disruption, transportation failure, serious illness, or equipment loss despite reasonable precautions. Payment obligations for work already completed remain due. The parties will communicate and seek a reasonable rescheduling, substitute performance, credit, or refund where appropriate.
18. Governing law and disputes
Before filing a formal claim, the parties will first try in good faith to resolve the issue directly through written notice and a reasonable opportunity to respond. Unless a project-specific agreement states otherwise, these terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any court proceeding must be brought in a court with jurisdiction where OpticsMedia Productions is principally located, except where consumer law requires another forum.
19. General terms
If a provision is found unenforceable, the remaining provisions continue in effect and the invalid provision will be limited to the minimum extent necessary. A failure to enforce a provision is not a waiver. You may not transfer your agreement or license without written permission. OpticsMedia Productions may transfer these terms as part of a lawful business reorganization or sale. Headings are for convenience only. These terms, together with applicable project agreements, releases, invoices, and displayed policies, form the agreement for the relevant service.
20. Updates and contact
These terms may be updated to reflect changes in services, technology, or law. The effective date above identifies the current version. Material changes apply prospectively unless law permits otherwise, and terms accepted for an existing paid project remain subject to any controlling project agreement. Contact OpticsMedia Productions through the website contact page with questions, accessibility requests, or notices concerning these terms.
